End User License Agreement

The license terms that cover your use of the software.

Last updated: 18 September 2026

This licence covers the code we give you to install on your own website. It sits alongside the Terms of Service, which govern the Services as a whole; where the two conflict, the Terms prevail.

Most of OSPRY is a hosted service you reach through the portal and the API, and nothing is licensed to you there beyond the right to use it under the Terms. This document exists because two pieces of our software do run on your site rather than ours, and you need permission to put them there.

1. What this covers

The Licensed Software is:

  • the OSPRY tag, the script you embed to enable visitor identification, served from our content delivery domains; and
  • the OSPRY consent management platform, the banner and preference interface you may deploy to meet the consent requirement in Section 5 of the Terms.

It includes any update, patch or replacement we deliver for either of them.

2. Licence

While your subscription is active and you are not in breach, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable licence to embed, serve and execute the Licensed Software on websites and applications you own or are authorised to administer, solely to use the Services.

Where you hold an agency or white-label agreement with us, that agreement determines whether you may deploy the Licensed Software on a client's property, and it prevails over this Section.

3. What you may not do

You must not:

  • copy, host or redistribute the Licensed Software other than by embedding it as we document;
  • modify, translate or create derivative works of it;
  • reverse-engineer, decompile or disassemble it, or defeat its minification, except to the extent applicable law says you may despite this restriction;
  • remove or obscure any notice in it, or present it as your own software except under a white-label agreement with us;
  • use it to collect data other than through the Services, or to send data to any endpoint other than ours and those we document;
  • deploy it on a site that breaches Section 5 or Section 7 of the Terms, including deploying it without a consent banner that blocks it until the visitor accepts.

4. Updates

The Licensed Software is delivered from our infrastructure and updates automatically. You do not choose a version, and you should not pin, cache beyond our stated headers, or self-host a copy. This is how a defect or a privacy fix reaches every site at once, which matters more for this software than version stability does.

If you self-host a copy in breach of this Section, you are responsible for what that stale copy does.

5. Ownership

We and our licensors own the Licensed Software and every intellectual property right in it. This licence grants permission to use it, and transfers nothing.

You own your website. Embedding the Licensed Software gives us no right to it.

6. Data

The Licensed Software collects information from visitors to your site. What it collects and where that goes is described in our Privacy Notice and our Cookie Notice.

You are the controller of your own site and are responsible for the notice and the consent that make that collection lawful, as Section 5 of the Terms requires. Our role in the data the tag produces is described in Section 1 of the Data Processing Addendum, which is not the same as our role in the data you upload. Read it before assuming we are your processor for everything.

7. Warranties

The Licensed Software is provided "as is". The disclaimers in Section 10 of the Terms apply to it in full, including that identification is probabilistic.

8. Termination

This licence ends when your subscription ends, or immediately if you breach it.

On termination you must remove the Licensed Software from every property you deployed it on. Until you do, it may continue to load and to collect, and you are responsible for that collection. We may also stop serving it, which will leave a request that fails rather than a tag that works.
